Key Concepts and Terms

User: a visitor to/user of the Company’s information resources integrated into the online service (https://premiumphuket.com), a potential buyer/consumer of the Company’s products/services.

Website: the official website of the Company (https://premiumphuket.com).

The Company is committed to safeguarding the privacy of, and protecting personal data. The Company recognizes its duty to safeguard confidential information. This Privacy Policy explains the Company’s right to collect and use data provided by the User on the Website. Personal data processing by the Company is governed by the privacy and security laws of Thailand.

Whether the User is searching for information or conducting business electronically, the Company will protect the User’s privacy regardless.

Online Data Collection and Use

The Company will not collect the personal data of Website visitors, unless the User elects to use or receive an online product or service that requires the submission of such data. All data collection is secured by state-of-the-art tech safeguards to assure the integrity and privacy of data and systems.

The Operator reserves the right to inform the User about new products and services, special offers, and different events. The User may at any time unsubscribe from news messages by emailing the Operator at (your mail) with this subject line: “Unsubscribe from new product/service notifications and special offers”.

User Data Collected by the Company

Personal data is any information that makes it possible to identify the individual. Any data devoid of identity (depersonalized) does not qualify as personal data.

The Company may collect, use, store, and transmit different types of Users’ personal data subsumed under the following categories:

  • ID data includes title, given name, last name, username, nationality, and gender;
  • contact details include postal address, email address, and telephone number(s);
  • profile data includes username and password, interests, preferences, feedback, and survey responses;
  • usage data includes record of the User’s use of the Website, products, and services of the Company;
  • marketing and communication data includes User’s preferences in regard to receiving marketing information from the Company or third parties, and User’s communication preferences;
  • technical data includes the Internet Protocol (IP) address used to connect User’s computer to the Internet, login credentials, browser type and version, time zone settings and location, browser plug-in types and versions, operating system and platform, other technologies on the devices the User employs to access the Website, visitation data, including full Uniform Resource Locators (URLs), clickstream to, through and from the Website (including date and time), products viewed or searched by User, page response times, loading errors, length of specific page visits, page interaction data (such as scrolling, clicks, and mouse-overs), and the method(s) used to browse away from the page.

User’s Failure to Provide Personal Data

Where the Company, whether by law or by contract, has the obligation to collect personal data yet the User fails to provide the same on request, the Company shall be at liberty to withdraw from the contract it has concluded or plans to conclude with the User (e.g., a service contract). In this event, the Company shall be at liberty to cancel the service provided to the User under the contract in question. The Company has the duty to promptly notify the User of service cancellation.

Data Tracking

The Company’s systems do not currently honor browser requests to disable tracking; the User is free to delete cookies and other tracking technologies.

Disclosure of User’s Personal Data

For operational reasons essential to the Company’s purposes, by virtue of the lawful grounds set forth in this Privacy Policy, the Company may disclose the User’s personal data to: (1) third-party service providers that administer the Website/platform and provide Internet services, host facilities, provide data storage services, customer relations services, marketing services, automotive transportation services, or customer survey services; (2) professional advisors such as lawyers, bankers, accountants, and insurers providing consulting, banking, legal, insurance or accounting services; or (3) third parties to whom the Company may sell, cede or merge parts of the Company’s undertaking or assets. Furthermore, the Company has the right to acquire or merge with other companies.

The Company has deployed safeguards to ensure that service providers use Users’ personal data in accordance with the terms of this Privacy Policy and applicable law, and that the same is used exclusively to deliver the products or services provided by the Company or where the Company deems such use necessary for a legitimate reason in conjunction with the products or services offered.

The said service providers and group companies may be located in the United Arab Emirates or elsewhere in the world. Privacy laws may be different in the host countries.

International Transmission

Some of the parties that process or store personal data pursuant to this Privacy Policy may be situated in jurisdictions outside the User’s country of residence or registration. Therefore, by giving their consent, the User understands and expressly agrees that their information may be processed and stored in such jurisdictions, and that the countries concerned may have different privacy laws that may not provide the same level of data protection as the User’s country of residence.

The Company will not enter into any agreements or transmit data unless an adequate level of protection is assured for any information stored in the respective country or unless the service provider operates in compliance with the applicable privacy laws. Where required under the laws for the time being in force, the Company will take steps to ensure that any personal data processed in other countries receives the same level of protection it receives in the User’s country.

Where the User’s personal data is transmitted to an overseas jurisdiction, it may become subject to the laws of that jurisdiction, and the Company may be liable to disclose such data to the courts, law enforcement authorities or government agencies of that jurisdiction.

Data Security

The Company has taken the appropriate security measures to prevent accidental loss, unauthorized use or access to the User’s personal data, alteration or unauthorized disclosure thereof. Furthermore, the Company has restricted access to personal data by limiting it to those employees, agents, contractors or other third parties that have the need to know such data for business purposes. Data is processed exclusively on the instructions of the Company. Employees having access to personal data are bound by the duty not to disclose the same.

The Company shall not accept liability in the event of unauthorized or inadvertent access that is beyond its control.

Data Storage

The Company may retain the User’s personal data for any period necessary to fulfill its purposes, which may include the need to satisfy any legal, regulatory, fiscal, accounting, or reporting requirements. The Company may keep the User’s personal data for a longer period of time in the event of a complaint having been filed or if the Company reasonably believes that legal proceedings may arise involving the User.

To determine the appropriate retention period for personal data, the Company will take into account the scope, nature, and sensitivity of the personal data in question, the potential risk of harm resulting from unauthorized use or disclosure of the User’s personal data, the purposes the personal data is processed to fulfil, the option of achieving the same purposes by other means, and the applicable legal, regulatory, fiscal, accounting, and other requirements involved.

The Company applies the following retention periods for User data:

  • personal data: 12 months
  • contact information: 12 months
  • profile data: until deleted
  • cookies: no more than 30 days.

In some cases, the Company may depersonalize personal data for research or statistical purposes so that it is no longer associated with the User, in which case the Company shall be free to use the data indefinitely without further notice to the User.

User Rights

Subject to the data protection laws currently in force, the User enjoys the following rights:

  1. right of access;
  2. right of correction;
  3. right to request deletion;
  4. right to restrict processing;
  5. right to object to processing;
  6. right to data portability;
  7. right to supervisory complaint;
  8. right to recall consent.

The User may exercise any of their rights with respect to their personal data by notice in writing to the Company.

User Obligations

Before the User may provide the personal data of a third party to the Company, the User shall obtain that party’s consent for the disclosure and processing of their personal data. This provision, however, does not apply where the User is the guardian, custodian or curator of a person under guardianship, or the biological or adoptive parent of a minor.

This Privacy Policy applies exclusively to data collected online on the Website and does not apply to any data collected offline.

Governing Law and Jurisdiction

All matters pertaining to the use of this Website or any related matters shall be governed by the laws and regulations of Thailand, and must be construed accordingly.

The courts of Thailand shall have exclusive jurisdiction over any claim arising out of the use of this Website or any issues related thereto or related to a Website visit, however, the Company reserves the right to take legal action against the User for infringement of the rules of use of the Website in the User’s country of residence or any other country, as the case may be.

Updating the Privacy Policy

The Company is at liberty to modify this Privacy Policy. Any edits shall be published on the Website and shall come into effect as of the date of publication. The User is advised to watch updates on the Website in order to stay posted on any changes to the Privacy Policy. By continuing to use the Company’s services, the User acknowledges and agrees to any such changes.
